1. Scope
These Terms and Conditions apply to all orders placed by consumers through the online store of Leot James Fine Clothing. For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
Any terms and conditions of the customer shall not apply unless their validity has been expressly agreed to in writing.

3. Subject Matter of the Contract
The subject matter of the contract is the sale of the goods offered through the online store.
Unless expressly stated otherwise, the items offered are predominantly pre-owned goods.
Descriptions, condition reports, measurements and photographs are prepared to the best of our knowledge and belief in order to describe the actual condition of each item as accurately as possible.
4. Conclusion of the Contract
The presentation of products in the online store does not constitute a legally binding offer but rather an invitation to place an order. By completing the order process, the customer submits a binding offer to enter into a purchase contract. After the order has been received, the customer will automatically receive an order confirmation by email. This confirmation merely acknowledges receipt of the order and does not constitute acceptance of the offer. The purchase contract is concluded only when the order is expressly confirmed or the goods are dispatched.

All prices are stated in Euro (EUR).
The prices displayed in the online store at the time the order is placed shall apply.
The Margin Scheme pursuant to Section 24 Austrian VAT Act (UStG) applies.
Shipping costs are shown separately during the checkout process.

7. Delivery
Delivery will be made to the delivery address provided by the customer.
Information regarding delivery times, shipping costs and the countries to which we ship can be found in our Shipping Policy. Should an item exceptionally become unavailable or cannot be delivered, the customer will be informed without undue delay. Any payments already made will be refunded without undue delay.
8. Retention of Title
The goods remain the property of Leot James Fine Clothing until full payment has been received.
9. Product Descriptions
The goods offered are described and photographed to the best of our knowledge. Descriptions, condition reports, measurements and photographs are intended to provide the most accurate possible representation of each item. Product photographs form part of the description of the respective item. Minor colour variations may occur due to differences in screen settings. Measurements are taken carefully but may vary slightly.
10. Condition Descriptions
As the goods offered are predominantly pre-owned, age-related or normal signs of use do not constitute defects, provided that they are apparent from the product description or product photographs.
Any notable characteristics or visible defects are described in the relevant product description to the best of our knowledge.
11. Unique Items
The majority of the goods offered are unique, one-of-a-kind items. Despite careful inventory management, in rare exceptional cases an item may no longer be available due to an inventory error or an overlapping sale. In such cases, the customer will be informed without undue delay. Any payments already made will be refunded without undue delay using the original payment method or, where payment was made by Bank Transfer, by Bank Transfer.
12. Statutory Warranty
The statutory warranty provisions shall apply.
13. Liability
Leot James Fine Clothing shall be liable in accordance with the applicable statutory provisions. Liability for damage resulting from intentional misconduct or gross negligence, as well as liability for injury to life, body or health, shall remain unaffected. To the extent permitted by law, liability for slight negligence is excluded.
14. Right of Withdrawal
Consumers have the statutory right of withdrawal.

15. Data Protection
Information on the processing of personal data can be found in our Privacy Policy.
16. Applicable Law
These Terms and Conditions shall be governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions applicable in the consumer's country of habitual residence within another Member State of the European Union shall remain unaffected.
17. Severability
Should any provision of these Terms and Conditions become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
